Terms & Conditions

At Travelling Masai, we want you to enjoy your trip and have the best possible experience. Please take the time to review our terms and conditions before booking your trip. We strive to provide clear and concise policies, but if you have any questions or concerns, please don't hesitate to contact us. We may be able to make exceptions upon agreement pre-booking, so don't be afraid to ask us for more information.

AGREEMENT BETWEEN LENGISIA TRAVELLING MAASAI SAFARIS LTD. (TRAVELLING MASAI, "COMPANY") AND THE GUEST

TRAVELLING MASAI TERMS AND CONDITIONS

​

1. BOOKING AND PAYMENT:

   a. To secure your booking, a deposit of 20% of the total amount is required.
   
   b. 50% of the total amount is due no later than 75 days before the scheduled arrival date.
   
   c. The remaining 30% must be paid no later than 14 days prior to the scheduled arrival date.
   
   d. Unless otherwise stated, the booked trip can be cancelled up until 21 day before the first day of the trip, after that, a 30% cancellation fee of the total amount will be applicable. The booked trip becomes non-refundable within 5 days of arrival.

2. PAYMENT FAILURE:

   a. Failure to complete payments by the specified deadlines will result in the automatic cancellation of the trip; refund of the amounts paid will be considered based on the same logic as stated in 1.d. above; an additional 5% will be charged for administration fees on top of the stated amounts.

3. CANCELLATIONS AND MODIFICATIONS:

​

   a. All bookings become non-refundable 5 days before the scheduled arrival date unless stated otherwise with potential exception that needs to be discussed and approved by Travelling Masai.
   
   b. No-shows are considered non-refundable.
   
   c. Changing dates may incur additional costs, which will be the responsibility of the guest.
   
   d. Modifications are subject to availability.
   
   e. Modification of the travel date does not change the deadlines for payments and cancellation policies.

4. GUEST RESPONSIBILITY:

   a. Guests are responsible for checking and meeting all travel requirements to the destination, including visa requirements, passport validity, and travel vaccinations (if applicable).
   
   b. Travelling Masai shall not be held responsible for any issues arising from the guest's failure to meet travel requirements.

5. TOUR ITINERARY

   a. Travelling Masai reserves the right to alter the order of the tour itinerary if necessary, without prior notice, due to unforeseen circumstances such as weather conditions, safety concerns, or other issues beyond the company's control.

   b. In the event of a minor alteration to the tour itinerary, Travelling Masai will make reasonable efforts to inform the guest in a timely manner.

   c. If a severe alteration to the tour itinerary is required, the guest will be given the option to either cancel the booking with a full refund or modify the booking for a different date. Any additional charges incurred due to modifications will be the responsibility of the guest.

   d. Travelling Masai shall not be held liable for any inconvenience, loss, or disappointment caused by changes to the tour itinerary.

6. FORCE MAJEURE

   a. Travelling Masai shall not be responsible for any failure or delay in performing its obligations under these terms and conditions, where such failure or delay is due to circumstances beyond the reasonable control of the company, including but not limited to acts of nature, government actions, war, terrorism, or other force majeure events.

   b. In the event of force majeure, Travelling Masai may, at its discretion, offer alternatives, reschedule the tour, or provide a refund as deemed appropriate.

7. COMMUNICATION

   a. The guest agrees to provide accurate and up-to-date contact information to facilitate effective communication regarding the booking and any changes to the tour itinerary.

   b. Travelling Masai will communicate important information primarily through the contact details provided by the guest at the time of booking.

 

8. GOVERNING LAW

   a. These terms and conditions are governed by and construed in accordance with the laws of Kenya, and any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

9. ACCEPTANCE OF TERMS AND CONDITIONS:

   a. Payment of the deposit automatically signifies the guest's acceptance of these terms and conditions.

By proceeding with the booking, the guest acknowledges that they have read, understood, and agreed to the terms and conditions outlined above. Travelling Masai reserves the right to update or modify these terms and conditions as needed, and such changes will be effective upon posting on the company's website or other communication channels. It is the responsibility of the guest to stay informed about any updates.
